Casinos across the United States offer their players promotional opportunities where items can be won, such as event tickets, dining passes and even vehicles. In the state of New York, the Rivers Casino & Resort hosted a promotional drawing last year, rewarding the winner with a new Jaguar or a $25,000 cash prize. The winner of the drawing is now suing the casino after stating the casino wrongly denied her the prize after winning.

Rivers hosted the Jaguar XE Giveaway last summer, allowing players to earn entries into the special drawing via their Rush Rewards Players Club Card. Deanna Dipofi visited the casino and had earned entries. She was chosen as the winner but was not present during the drawing. Because she was not onsite, the prize when to another player.

The attorneys for Dipofi are arguing that they did not stipulate that the winning player had to be onsite during the drawing, with no condition set on claiming the prize. The lawyer group representing Dipofi, Alan Ripka & Associates, are located in Manhatton and stated that the casino has stipulated such conditions in previous promotional drawings.
